Membership Terms and Conditions

INTRODUCTION

Welcome to Estimra Plus! These Membership Terms and Conditions ("Terms") outline the guidelines governing our relationship with you. While we've endeavored to simplify these Terms, please note that they constitute a legally binding agreement between you and Estimra Pty. Ltd (ABN 29648855369). When we refer to "our," "we," or "Estimra," we mean Estimra Pty. Ltd. The terms "Subscriber" and "member" are used interchangeably. Please review these Terms carefully. By using our services and/or purchasing our products, you agree to abide by the following Terms.

Estimra operates a membership rewards platform called Estimra Plus. This subscription is exclusively for Australian residents, it offers subscribers various benefits, including up to 70% sitewide discounts and giveaways. These benefits are accessible only to subscribed members. Members are automatically entered into giveaways and gain access to a dedicated portal for profile management, payments, and updates. Membership cancellation is available at any time, and the platform aims to enhance brand awareness.

To sign up for an Estimra Plus membership, you must be at over the age of 18 years old. Membership is contingent upon adherence to the terms and conditions governing the Estimra Plus website. By subscribing to Estimra Plus, you agree to these Terms and our Privacy Policy. Please review these documents thoroughly before subscribing.

 

MEMBERSHIPS

Estimra Plus memberships are ongoing subscriptions to our rewards platform, billed until canceled by you or terminated by us in accordance with these Terms. Members enjoy exclusive perks, including:

1. Member will receive 50% off all products (jewelry collection). This discount can be used anytime however not in conjunction with another discount. This discount is only available to members.

2. Member will have access to flash sales of up to 70% off all products (jewelry collection). These flash sales are only available to members and will occur sporadically through the year.

3. Free entry in promotional draws and giveaways. These are only available to members. 

ENTRIES INTO TRADE PROMOTIONAL DRAWS AND GIVEAWAYS

Every active member who purchases an Estimra Plus subscription will automatically be entered into every trade promotional draw and giveaway, no further action is required by the member in order to enter these draws and giveaways. These giveaways are free to enter and only available to Estimra Plus subscribers. Each member account will have 1 free entry into promotional draws and giveaways. Members cannot purchase multiple entries. Entries to these promotional draws and giveaways are subject to the terms and conditions on our website.

Entries are considered received by the Estimra Plus upon their receipt, rather than at the time they are transmitted or deposited by the entrant. The records maintained by the Estimra Plus are considered definitive and conclusive regarding the timing of receipt.

 

Estimra Plus will collect, store, and utilize the personal information of all participants in compliance with its Privacy Policy accessible on www.estimraplus.com. This information may be employed for purposes such as identity verification, and for potential future marketing endeavors related to Estimra Plus products and services which may involve electronic communication with the participant. 

 

Entries that are incomplete, indecipherable, inaudible, incorrect, or illegible, as determined by the Promoter, may be considered invalid and ineligible for winning at the discretion of the Promoter. The use of any automated entry software or any other mechanical or electronic means that enables an individual to enter repeatedly automatically is prohibited and may result in disqualification of all entries submitted by that individual.

 

Estimra Plus retains the authority to disqualify entries if they fail to comply with these Terms and Conditions. In the event of any dispute regarding the conduct of Estimra Plus,  Estimra Plus decision is conclusive and binding for all entrants, with no further correspondence entered into by Estimra Plus with any claimant.

 

WINNER NOTIFICATION

The draws will take place at the times nominated by Estimra Plus, this will be done using a computerised random selection and thus the winner of a drawn prize is determined by chance. In the event of a disagreement regarding the identity of an entrant or winner, the Estimra Plus retains the authority, at its discretion, to ascertain the identity of the entrant or winner. The winner will be contacted by both text and email. It is imperative the member ensures they enter in their correct details. The winner must claim their prize by replying to the promoter and then following the necessary steps to nominate a deposit account that is held in their name. This must be an Australian bank account. The winner's first name and the first letter of their surname will be published on the Estimra Plus website and other social media accounts owned by Estimra Plus. The prize must be claimed within 7 days of the first email and text sent. Within those 7 days, all reasonable attempts will be made to contact the winner however if the prize is not claimed within 7 days Estimra Plus is not obliged to substitute the prize.

 

If any part of the the draw becomes unable to proceed as intended, whether due to computer viruses, communication network issues, bugs, tampering, unauthorized interference, fraud, technical malfunctions, or any other unforeseen circumstances beyond the control of Estimra Plus, they reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Promotion. This may include invalidating affected entries, or suspending or modifying a prize, in accordance with State or Territory regulations.

 

At any given time, Estimra Plus retains the authority to verify and authenticate entries as well as entrant information, which includes identity, age, and place of residence. Should a winner fail to provide adequate proof as requested by Estimra Plus to authenticate their entry, the winner will forfeit the prize in its entirety, and no replacement will be provided.

 

Estimra gift cards, digital gift cards are not refundable and cannot be exchanged for cash.

 

TERMINATION OF MEMBERSHIP

You may cancel your membership at any time by simply reaching out to support@estimraplus.com and request cancellation. Please note that no refunds are available for Estimra Plus Subscriptions. If a recent payment has been processed, kindly ensure to cancel your membership at the conclusion of the billing period. There are no refunds on Estimra Plus Subscriptions. If a payment has recently been made, please cancel your membership at the end of the billed period.

Once the cancellation process is complete, you will be sent a confirmation email. No refund will be offered if you cancel your membership mid-billing cycle for any reason or if you do not complete the cancellation process before the payment comes out. 

Cancellation of your membership will not remove you from our marketing database. To remove yourself from our marketing database simply email us at support@estimraplus.com.

If your account fails to pay, there will be a 14 day grace period. Throughout this grace period, there will be automatic attempts to retrieve the overdue payment. If there is no success in paying the outstanding bill after 14 days, your subscription will be terminated.

If you cancel your subscription then change your mind, you will have to create a new subscription.

 

GIVEAWAY DISCLAIMERS

By becoming a member of the Estimra Plus subscription platform you will automatically enter into the giveaways. The Participant agrees to enter the Contest and Agrees that:

 

• Any and all disputes, claims and causes of action arising out of or in connection with the Contest and the promotional gifts shall be resolved individually with any form of class action.

• Any disputes, claims, or legal actions arising from the contests and promotional gifts will be handled individually, and class actions are not permitted.

• Claims, judgments, and awards are limited to actual out-of-pocket expenses incurred in entering the contests. Estimra bears no responsibility for legal fees.

• Participants waive the right to claim punitive, incidental, or consequential damages, except for actual out-of-pocket expenses related to contest entry.

• Estimra, its affiliates, subsidiaries, and partners, including their officers, directors, employees, and agents, are not liable for any damages or losses resulting from website access, electronic malfunctions, or contest participation.

• Estimra reserves the right to disqualify participants found tampering with the contest or abusing its rules.

• In case of unauthorized intervention or other circumstances beyond Estimra's control compromising the contest's fairness, Estimra reserves the right to suspend, modify, or terminate it.

• Deliberate attempts by participants to disrupt the contest's legitimate operation may result in legal action by Estimra.

• Estimra is not responsible for technical malfunctions affecting contest participation, including computer systems, servers, or email systems.

• The contest is void where prohibited by law, and Estimra reserves the right to suspend, modify, or terminate it if necessary to ensure fairness and security.

 

CHANGE OF DETAILS

You should notify us of any change of name, address, contact number, email address or billing information by updating your details online at com, by emailing us at support@estimraplus.com. We will not be responsible for any failure by you to notify us of your change of details, which may result in you not obtaining the full benefit of your Estimra Plus membership.

 

LIABILITY

We acknowledge that we cannot exclude, restrict, or modify any rights and remedies concerning goods or services as outlined in the Competition and Consumer Act (2010). However, the rest of this provision will be enforced to the maximum extent permitted by law. Neither we nor our partners shall be held liable (including in cases of negligence) for any loss (including, but not limited to, indirect, special, or consequential loss, or loss of profits), expense, or damage suffered in connection with Estimra Plus membership, nor for any personal injury, illness, or death sustained, except where such liability cannot be excluded by law.

GENERAL TERMS AND CONDITIONS

We disclaim any responsibility for tax implications resulting from your use of the Estimra Plus platform or any benefits derived from it. We reserve the right to exclude or suspend you from the platform or from receiving benefits if you:

• Engage in conduct that may disrupt the proper functioning of the Estimra Plus platform.

• Act in a disruptive, annoying, threatening, abusive, or harassing manner.

• Take actions that may tarnish the reputation of us, our partners, or any related entities or contractors.

• Violate any laws related to the Estimra Plus platform or our promotional activities.

• Behave in a manner that we reasonably deem inappropriate.

 

You are not permitted to assign or attempt to assign any rights or liabilities under these terms and conditions without our prior written consent. Any provision of these terms and conditions intended to survive termination or expiration will remain in effect.

 

All monetary references in these terms and conditions are in Australian dollars. We reserve the right to amend these terms and conditions, with such amendments taking effect upon posting on the Estimra Plus website or notification to members. If you do not agree to any amendments, you may cancel your Estimra Plus membership.

 

We may cease offering memberships by providing sufficient notice to members on the Estimra website or through other means, ensuring that termination does not unreasonably harm members financially or otherwise.

 

These terms and conditions are governed by the laws of New South Wales, Australia.
